Dr. Daniela Kinkeldey

As a partner in our intellectual property team in Munich, I advise and represent our clients in IP law, particularly in life sciences.

While my technical speciality is in organic and pharmaceutical chemistry, I also represent our clients in other fields of chemistry including fibres and inorganics, as well as medical devices such as IV catheters, artificial heart valves and respiratory masks.

I have in-depth experience in European and German patent law, obtaining patents, defending and attacking patents in opposition proceedings before the German and European Patent Office and acting in nullity suits before the German Federal Patent Court and the Federal Supreme Court.

In addition, I am also involved in infringement proceedings together with our litigation team, and have expertise in the coordination of international proceedings across multiple jurisdictions. I also advise our clients on questions of the German employee inventors' law.

• Nanotech: Advising in four patent disputes regarding methods for the manufacture of 'aerogel mats' (used for insulation e.g. of gas and oil pipelines), representation before EPO and Federal Patent Court with regard to three nullity proceedings.
• Celanese Emulsions: Representing in numerous opposition proceedings regarding paint additives and acidic acid production.
• Fisher & Paykel: Representing the client both as plaintiff and as defendant in a number of opposition and nullity proceedings before the EPO and the Federal Patent Court against ResMed regarding medical devices (respiratory masks); coordination of proceedings in the UK and USA.
• KCC Corporation: Representing in opposition and nullity proceedings before the EPO and the Federal Patent Court against Rogers Germany GmbH; participation in patent infringement proceedings.
• B.Braun Melsungen: Representing patent portfolio worldwide regarding IV catheter; representation in opposition and nullity proceedings before the EPO and the Federal Patent Court.
