Henri Kaikkonen

As a partner at our Helsinki office, I lead our Finnish Intellectual Property Group. My practice encompasses IP litigation, protection and commercialisation of IP rights, and regulatory advice, particularly in the Life Sciences, Medical Devices, and Food & Beverage sectors.

I have extensive experience in cross-border disputes involving trademarks, patents, trade secrets, and unfair business practices. My litigation expertise includes preliminary injunctions, invalidity actions, criminal enforcement of IP rights, and IP-related damages.

During my career of over 10 years, I have had the privilege to work with the most prestigious brands and technologies. I have managed their international trademark portfolios and ensured that their new products are cleared from third-party IP risks and protected with trademarks and other IP rights, as well as developed several IP strategies and guidelines, such as employee invention policies. Recently, I have been advising more and more clients on data sharing and artificial intelligence, focusing on trade secrets, copyright, and database rights.

I am an experienced negotiator of IP-intensive agreements, in particular to develop and license new technologies, and to commercialise creative products. My work in this area spans industries such as mechanical engineering and process technologies, as well as media and entertainment, including film and television production.

I also advise our clients on regulatory issues in the life sciences, medical devices, and food and beverage sectors. My expertise includes marketing, labeling, and product recalls, often involving administrative proceedings with authorities.

I am an active member of the Finnish IP community, currently serving as the secretary of the Finnish Association for Industrial Property Rights. I have also served as secretary and board member of the Finnish Anti-Counterfeiting Group and frequently lecture on IP topics.

• Advising a telecoms company in unfair business practice disputes. The claims concerned illegal comparative advertising and misleading marketing claims.
• Advising a process machine manufacturer in multijurisdictional patent infringement dispute. The case included questions on seizure of evidence.
• Advising a hardware retailer in the management of their trademark portfolio. Our work includes new applications, oppositions and brand development on an ongoing basis.
• Advising a luxury brand company in defending their trademark against copycats. The cases have also included questions on misleading and defamatory marketing.
• Advising a food and beverage company in a product recall dispute with the authorities. The case included questions on prohibited novel foods.
• Advising a media company in a trademark and contractual dispute over rights to a television format. The case included questions on bad faith trademark application.
• Advising a pharmaceuticals company in research, contract manufacturing and licensing agreements. Our cooperation has lasted several years on an ongoing basis.
• Advising a SaaS company in their group rebranding, the related IP clearance searches and new trademark applications. We also took care of implementing updates to the group company names.
• Advising a life sciences company in a distressed R&D project and the related damages claims. The case ended to an amicable settlement to our client.
• Advising an ingredient branding company in R&D and licensing cooperations. We have also advised the client in regulatory matters concerning e.g. green claims.
• Advising a food and beverage company in trademark oppositions before the Finnish TM authorities and courts of appeal.
